TERMS AND CONDITIONS

1. COMPANY INFORMATION

In these Terms and Conditions, “Villa Isabella”, “the Company”, “we”, “us” and “our” refer to SAN BENEDICTO INVERSIONES, S.L.U.


2. SCOPE OF THESE TERMS

These Terms and Conditions govern:

  1. direct tourist bookings for Villa Isabella in Tenerife made through our website or direct booking system;
  2. the booking conditions and house rules applicable to stays at Villa Isabella;
  3. bookings made through third-party platforms where these Terms have been included, incorporated or referenced in the property listing or booking confirmation;
  4. and the use of services and facilities connected with the accommodation.


Property-specific information, including maximum occupancy, minimum stay, tourist registration number, available facilities and included services, is shown in the relevant property listing and booking confirmation.

By completing a booking, the person making the reservation confirms that they have read and accepted these Terms on behalf of all guests included in the reservation.


3. TOURIST ACCOMMODATION IN TENERIFE

Villa Isabella is offered as temporary tourist accommodation in Tenerife.

The accommodation is not offered as the Guest’s permanent residence and does not create a residential tenancy.

The booking holder must:


  1. be at least 24 years old;
  2. have legal capacity to enter into the booking contract;
  3. provide accurate booking information;
  4. stay at the property for the entire reserved period;
  5. and ensure that every guest and visitor complies with these Terms.


4. AVAILABILITY AND BOOKING CONFIRMATION

Availability displayed on the website may change until the booking process has been completed.

A booking becomes binding when:

  1. the Guest has completed the booking process;
  2. the required payment or payment authorisation has been received;
  3. and Villa Isabella has issued a written booking confirmation.


The Guest must check the confirmation immediately and notify us without delay of any incorrect dates, guest details or other errors.

The booking confirmation, selected rate conditions, these Terms and the applicable property information together constitute the accommodation agreement.

In the event of a manifest technical or pricing error, we will inform the Guest as soon as reasonably possible and offer the option of confirming the booking at the correct price or receiving a full refund of any amount already paid.


5. PRICES

Prices are stated in euros unless expressly indicated otherwise.

The total price, applicable taxes, payment schedule and any additional services or charges will be displayed before the booking is confirmed.

The price includes only the accommodation, services and facilities expressly stated in the selected offer or booking confirmation.

Optional services requested after confirmation may be subject to an additional charge agreed in advance.

Property descriptions, photographs and prices are prepared with reasonable care. Minor differences may arise as a result of maintenance, improvements, replacement of furniture or seasonal changes.


6. PAYMENTS

The amount and due date of the initial payment and any outstanding balance are specified during the booking process and in the booking confirmation.

Payments must be completed using one of the accepted payment methods.

The person making the payment confirms that they are authorised to use the relevant card or payment account.

If payment is not received by the stated deadline, Villa Isabella may send a payment reminder and, after reasonable written notice, cancel the booking.

Where a booking is cancelled because the Guest has failed to make a required payment, the cancellation conditions applicable to the selected rate will apply.


7. CANCELLATION POLICY FOR DIRECT BOOKINGS

Unless a different promotional or non-refundable rate is clearly displayed and accepted during the booking process, the following cancellation policy applies to direct bookings:


  1. Cancellation 30 or more calendar days before the scheduled check-in date: refund of 100% of the amount paid.
  2. Cancellation between 29 and 15 calendar days before the scheduled check-in date: refund of 50% of the amount paid.
  3. Cancellation 14 calendar days or fewer before the scheduled check-in date: no refund.
  4. Cancellation deadlines are calculated according to the local time at the booked property.
  5. Cancellation requests must be submitted in writing to:

The effective cancellation date is the date and time on which the written request is received.

Refunds will be made using the original payment method. Bank and payment-provider processing times are outside the Company’s control.

A non-refundable rate or different promotional cancellation policy will apply only when it has been clearly displayed before confirmation and expressly accepted by the Guest.


8. DATE CHANGES

Requests to change travel dates are subject to availability and any applicable price difference.

A date change may be treated as a cancellation and a new booking, particularly when requested within the applicable cancellation period.

Any change is valid only when confirmed in writing by Villa Isabella.

Reducing the number of nights or guests after confirmation does not automatically entitle the Guest to a refund.


9. NO-SHOWS AND EARLY DEPARTURES

No refund is due in the event of:

failure to arrive;

arrival after the reserved check-in date;

voluntary early departure;

reduction in the number of guests;

failure to provide the documentation required for check-in; or

termination of the stay due to a serious breach of these Terms.

These provisions do not affect any mandatory rights that the Guest may have under applicable law.


10. BOOKINGS THROUGH THIRD-PARTY PLATFORMS

Bookings made through Booking.com, Airbnb, Vrbo or another third-party platform are subject to the price, payment terms, cancellation conditions and refund rules displayed and accepted on that platform.

Platform-specific conditions may differ from the conditions applicable to direct bookings.

In the event of a conflict concerning payment, cancellation or refund conditions, the terms accepted on the relevant booking platform shall prevail for that reservation.

Service fees charged directly by a platform are governed exclusively by that platform’s refund policy.

Villa Isabella’s occupancy limits and house rules continue to apply when they have been displayed, incorporated or referenced in the relevant listing or booking confirmation.

Changes, cancellations and payment enquiries concerning a platform booking must normally be processed through the platform on which the reservation was made.


11. REFUNDABLE SECURITY DEPOSIT

For direct bookings, a refundable security deposit of EUR 1,000 may be required.

The requirement and collection method will be clearly stated before the booking is confirmed.

The security deposit may be collected by:

payment-card pre-authorisation;

secure payment link; or

another method agreed before check-in.

Reasonable and documented deductions may be made for:

  1. damage caused by the Guest, another guest, a visitor or an approved pet;
  2. missing or damaged furniture, equipment or household items;

lost keys, access cards, alarm controls or remote controls;

smoking inside the property;

extraordinary cleaning;

unauthorised parties, events, guests or animals;

unpaid optional services;

unauthorised late check-out; or

another material breach resulting in a demonstrable cost.

Normal wear and tear will not be charged.

The deposit or remaining balance will be released or refunded within 14 calendar days after check-out and inspection of the property.

If additional time is reasonably required to obtain an estimate or invoice, the Guest will be informed in writing and any undisputed balance will be returned.

The time taken by the Guest’s bank to release a card pre-authorisation is outside the Company’s control.

The Guest remains responsible for documented damage or losses exceeding the security deposit.


12. CHECK-IN AND CHECK-OUT

Standard check-in is from 4:00 p.m. to 7:00 p.m.

Standard check-out is no later than 10:00 a.m.

The Guest must communicate the expected arrival time in advance.

Late arrival or late check-out is permitted only with prior written approval and may be subject to an additional charge communicated in advance.

Unauthorised late check-out may result in a charge corresponding to the additional costs caused, including additional cleaning or the inability to accommodate the next guests.


Before leaving, guests must:

  1. return all keys and access devices;
  2. close and secure doors and windows;
  3. switch off lights, air-conditioning and appliances as instructed;
  4. dispose of rubbish in the designated containers;
  5. and leave the property in a reasonably tidy condition.


13. GUEST IDENTIFICATION AND REGISTRATION

All guests must provide the identification details and documents required by Spanish law for the registration of persons staying in tourist accommodation.

Guests over the legally established age may be required to sign or electronically validate their registration information.

Information concerning younger guests must be provided by their parent, guardian or accompanying responsible adult.

Failure to provide valid identification or legally required information may result in check-in being refused or delayed.

No refund will be due where accommodation cannot be provided because the Guest has refused to comply with a mandatory registration requirement.

Personal data collected for guest registration will be processed in accordance with the Privacy Policy and applicable law.


14. OCCUPANCY AND VISITORS

The maximum occupancy stated in the property listing and booking confirmation must not be exceeded.

Children are included in the occupancy limit unless expressly stated otherwise.

Only guests included in the reservation and properly registered may stay overnight at the property.

Visitors are permitted only with prior approval and must not cause the maximum occupancy to be exceeded.

The booking may not be transferred, assigned or sublet.

The booking holder is responsible for the conduct of all guests, children, visitors and approved pets.


15. HOUSE RULES

The following rules apply to Villa Isabella:

Parties, receptions and events are not permitted.

Smoking and vaping are prohibited inside the property.

Quiet hours are from 11:00 p.m. to 8:00 a.m.

Guests must respect neighbours, community rules and shared areas.

Illegal, dangerous, disruptive or antisocial activities are prohibited.

The property may not be used for commercial activities, professional photography or filming without prior written permission.

Furniture and equipment must not be removed or substantially rearranged.

Fire-safety equipment, alarms, pool equipment and technical installations must not be tampered with.

Barbecues may be used only in designated areas and in accordance with the instructions provided.

Air-conditioning, water, electricity and other utilities must be used responsibly.

Electric vehicles may not be charged from domestic sockets unless a designated charging point has been expressly provided.

Doors, windows and access points must be secured whenever guests leave the property.


16. PETS

Pets weighing no more than 10 kg are accepted only upon prior request and written approval from Villa Isabella.

The request must specify the type, breed, number and weight of the animals.

Any applicable pet or additional cleaning charge will be communicated before confirmation.


Approved pets must:

  1. remain under appropriate supervision and control;
  2. not disturb neighbours;
  3. not enter the swimming pool;
  4. not climb onto beds, sofas or upholstered furniture;
  5. not be left alone where this may cause distress, noise or damage;
  6. comply with applicable identification and health requirements;
  7. and have their waste collected and disposed of immediately.


The Guest is responsible for all damage, extraordinary cleaning or third-party claims caused by an approved pet.

These restrictions do not affect legally recognised assistance animals.


17. CHILDREN AND POOL SAFETY

Children are welcome but must remain under the supervision of a responsible adult.

The swimming pool is not supervised by a lifeguard. Guests use the pool and surrounding areas at their own risk.

Children, non-swimmers and vulnerable persons must be supervised at all times.


The following are prohibited:

  1. running around the pool;
  2. dangerous diving or jumping;
  3. pushing people into the water;
  4. using glass objects in the pool area;
  5. tampering with pool equipment, covers or safety devices;
  6. and allowing approved pets to enter the pool.


Where pool heating is included or purchased, the achievable water temperature may be affected by weather conditions, water use and technical limitations.

A precise constant temperature cannot be guaranteed unless expressly confirmed in writing.


18. INCLUDED SERVICES AND UTILITIES

Only services and facilities expressly stated in the property listing or booking confirmation are included in the price.

Final cleaning does not include extraordinary cleaning resulting from misuse, smoking, unauthorised animals, parties or excessive rubbish.

Daily cleaning, linen changes, additional towels, transport and other supplementary services are not included unless expressly confirmed.

Internet access is provided for normal domestic use. Continuous availability, speed or suitability for professional activities cannot be guaranteed.

Temporary interruptions to electricity, water, internet, air-conditioning, pool heating or other services caused by external suppliers, maintenance requirements or circumstances outside the Company’s reasonable control do not automatically entitle the Guest to compensation.

Villa Isabella will take reasonable steps to restore the affected service or reduce the inconvenience.


19. DAMAGE AND LOST ITEMS

The Guest must notify Villa Isabella promptly of any damage, defect, malfunction or safety issue.

Guests must not arrange repairs or allow third parties to access technical installations without prior authorisation, except where immediately necessary to prevent personal injury or serious property damage.

The Guest must pay the reasonable and documented cost of repairing or replacing items damaged, lost or removed during the stay, excluding normal wear and tear.

Lost property will be kept for a reasonable period.

Shipping and handling costs for returning personal belongings are payable by the Guest.


20. ACCESS TO THE PROPERTY

SAN BENEDICTO INVERSIONES, S.L.U., its representatives and authorised technicians may access the property when reasonably necessary to:

  1. respond to an emergency;
  2. prevent damage or address a safety issue;
  3. carry out urgent repairs;
  4. inspect reported damage or malfunction;
  5. provide an agreed service;
  6. or comply with a legal or administrative requirement.


Except in an emergency, reasonable notice will be given and unnecessary interference with the Guest’s stay will be avoided.


21. COMPLAINTS AND PROBLEMS DURING THE STAY

Any problem affecting the accommodation must be reported as soon as reasonably possible by telephone, email or through the communication channel used for the booking.

The Guest must allow Villa Isabella a reasonable opportunity to inspect and remedy the problem during the stay.

Waiting until after departure to report a problem may limit our ability to verify or resolve it, without affecting mandatory consumer rights.

Official complaint forms are available in accordance with applicable consumer and tourism legislation.


22. CANCELLATION OR MATERIAL CHANGE BY THE COMPANY

If Villa Isabella becomes unavailable because of a serious technical problem, safety issue or other circumstance preventing the stay, we will inform the Guest as soon as reasonably possible.

Where possible, the Guest may be offered suitable alternative accommodation.

If no acceptable alternative can be provided, amounts paid directly to SAN BENEDICTO INVERSIONES, S.L.U. for the unavailable accommodation will be refunded.

If a material problem affects only part of the stay, the Company and the Guest will seek a reasonable solution, which may include:

  1. an alternative service;
  2. a proportionate price reduction; or
  3. a refund for the affected part of the service.


Nothing in this section limits the Guest’s mandatory legal rights.


23. FORCE MAJEURE AND TRAVEL INSURANCE

Neither party shall be responsible for failure or delay caused by circumstances beyond its reasonable control, including:

  1. natural disasters;
  2. severe weather;
  3. fire;
  4. interruption of public services;
  5. government restrictions;
  6. public-health emergencies;
  7. civil disorder;
  8. or major transport disruption.


The consequences of such circumstances will be handled in accordance with the selected booking conditions and mandatory applicable law.

Guests are advised to obtain suitable travel insurance covering cancellation, illness, travel disruption, personal belongings and personal liability.


24. LIABILITY

SAN BENEDICTO INVERSIONES, S.L.U. is responsible for providing the confirmed accommodation and services with reasonable care and in accordance with applicable law.

The Company is not responsible for loss or damage caused by:

  1. the Guest’s own act, omission or negligence;
  2. another member of the Guest’s party;
  3. an unauthorised visitor or animal;
  4. an unrelated third party;
  5. failure to follow safety instructions;
  6. or circumstances outside the Company’s reasonable control.


Guests are responsible for safeguarding their valuables and using available security equipment appropriately.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud, wilful misconduct or mandatory consumer rights.


25. TERMINATION OF THE STAY

SAN BENEDICTO INVERSIONES, S.L.U. may require the Guest and their party to leave Villa Isabella where there is a serious or repeated breach involving:

  1. an unauthorised party or event;
  2. excessive occupancy;
  3. serious disturbance to neighbours;
  4. intentional or reckless damage;
  5. smoking inside the property;
  6. an unauthorised pet;
  7. illegal or dangerous activity;
  8. violence, threats or abusive conduct;
  9. or refusal to comply with an essential safety or legal requirement.


Where appropriate, the Guest will first be asked to stop or remedy the breach.

Termination does not remove the Guest’s responsibility for outstanding payments, damage or documented costs.

Any refund entitlement will be determined according to the circumstances, the accepted booking conditions and mandatory law.


26. RIGHT OF WITHDRAWAL

Accommodation services provided for specific dates or a specific period are not subject to the general 14-day right of withdrawal applicable to certain distance contracts.

The cancellation conditions displayed and accepted when the booking is made therefore apply from the moment the reservation is confirmed, without prejudice to mandatory consumer rights.


27. PERSONAL DATA

Personal data is processed in accordance with the Villa Isabella Privacy Policy and applicable data-protection legislation.

Booking and identification information may be communicated to public authorities, payment providers, booking platforms and service providers where necessary to perform the contract or comply with a legal obligation.


28. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law.

Tourist stays at Villa Isabella are also subject to the applicable tourism and consumer legislation of the Canary Islands.

Any dispute shall be submitted to the court or authority determined by mandatory law.

Nothing in these Terms deprives a consumer of the protection or jurisdiction granted by the law of their place of residence where such protection is mandatory.


29. CHANGES TO THESE TERMS

The version of the Terms accepted when the booking is made applies to that reservation.

Subsequent amendments published on the website will apply only to future bookings and will not retroactively alter an existing confirmed booking unless required by law or expressly agreed by both parties.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.
